Action Needed: Fee Cap on 3rd Party Delivery Services
This Thursday (7/1) at 11AM the NYC Council is hosting a critically important public hearing on a package of legislation to reform the third-party delivery industry.
We need affected restaurants to sign up and testify via Zoom. This is very important.
The legislation would:
Make the temporary fee cap on third-party delivery companies permanent. The cap is a 5% fee cap on listing a restaurant on a third-party delivery company's website and marketing, and an additional 15% fee cap if the third-party delivery company does the physical delivery (click here to read legislation)
Make permanent the temporary law prohibiting third-party delivery services from charging restaurants fees for phone calls that do not result in an order. (click here to read legislation)
Require that third-party delivery services receive your permission before they list your restaurant(s) on their website. (click here to read legislation)
Require third-party delivery services that create secondary phone numbers for restaurants for which they charge a fee to disclose to the customer that the number is not the restaurant's direct number and also disclose any associated fees to the restaurant or customer for using such non-direct phone number. WE KNOW THE THIRD-PARTY DELIVERY COMPANIES WILL LINE UP IN OPPOSITION TO THE FEE CAP AND THE OTHER BILLS. COMPANIES LIKE GRUBHUB AND SEAMLESS WILL MAKE UP STORIES AND MISLEAD RESTAURANTS AND CITY COUNCIL MEMBERS TO TRY AND STOP THE LEGISLATION FROM PASSING SO THEY CAN EXPLOIT INDEPENDENT RESTAURANTS EVEN MORE!!!
The public hearing starts and 11AM on Thursday and will last several hours. You are welcome to watch from the beginning or login at noon
You will receive an email with a Zoom link before the hearing.
Prepare 1-2 minutes of written testimony explaining why the fee cap is so important to your restaurant. And why the other bills, like stopping bogus charges and prohibiting listings without your restaurants permission are important
Make your testimony personal. Explain your bad experiences with third-party delivery companies and why the fee cap and other bills are so important for your restaurants, especially as we recover from the pandemic.
What to expect: You will login to Zoom and can watch the hearing. When it is your time to testify a person will call on you and unmute you. You then have 1-2 minutes to read your testimony. After you finish, there’s a chance Council Members may ask you questions. After that, you may logoff.
We need people to testify on Zoom, but if there is no way you can, you may submit written testimony to info@thenycalliance.org and we will submit it to the record.
